WELLSBURG - A Wellsburg man who allegedly broke into the Hooverson Heights home of an elderly couple, demanding money last spring was among 11 indicted by a Brooke County Grand Jury Monday.
Presided by Circuit Court Judge Ronald Wilson, the grand jury returned an indictment against Aaron Michael Hartley, 20, of Wellsburg, on two counts each of first-degree robbery and assault during the commission of a felony and one count of burglary.
The charges stem from a May 2 incident in which Hartley allegedly forced his way into a home on Elaine Avenue, where he threatened the elderly husband and wife with a gun and struck both, according to the indictment.
According to police reports, the husband struggled with Hartley for a while while the wife went to a neighbor's to call 911 before Hartley fled the home.
At the time the couple told Brooke County sheriff's deputies the man wore a hood that helped to conceal his face.
The intruder's black hooded sweatshirt was found outside the home, and it wasn't until November, following a lengthy investigation, that sheriff's deputies arrested Hartley in connection with the crime, according to the sheriff's department.
Also indicted were:
Joshua Kleiner, 22, of Windsor Heights, for five counts of first-degree sexual assault and one count of attempting to commit sexual assault for alleged inappropriate contact of a sexual nature with a mentally impaired man and an attempt to make such contact between Nov. 1 and Jan. 2.
Brooke County Assistant Prosecutor David F. Cross said Kleiner himself has some degree of mental impairment but is able to distinguish right from wrong.
David M. Minger, 37, of 148 Beverly Ave., Weirton, for malicious assault for allegedly striking a man known to him in the head with a large rock following a dispute over a child custody matter.
