Resident sues Hancock House

NEW CUMBERLAND - A Hancock House resident is suing the low-cost apartment complex for injuries she suffered in 2011 while unloading groceries from her car.

Mildred L. Moninger, represented by attorney M. Eric Frankovitch, filed suit in 1st Judicial Circuit Court in Hancock County, asking for a jury trial and any damages allowable by law.

The lawsuit alleges that Hancock House, 720 Third Ave., New Cumberland, a provider of low-cost housing to senior citizens and people with disabilities, failed to take proper care of the premises on the day Moninger was injured. Moninger was unloading groceries from her car in the Hancock House parking lot on Sept. 16, 2011, when she "was caused to fall due to hazardous conditions permitted to exist" by Hancock House, the lawsuit said.

Those conditions included a severely sloped hill on the edge of the parking lot, overgrown weeds, grass and shrubbery near the edge of the lot, and an absence of guardrails, the lawsuit said.

Moninger suffered "severe and disabling" injuries as a result of the fall, was forced to seek medical treatment and incurred medical expenses, the lawsuit said.

The lawsuit charges the eight-floor Hancock House with failure to maintain the property, failure to provide a safe environment for residents, failure to correct hazardous conditions and failure to warn residents of hazards.

In addition to Hancock House Ltd., Moninger names as defendants Colonial American Development Corp., of Columbus, Ohio, and Columbus architect George J. Kontogiannis. Colonial American manages Hancock House and a number of other Section 8 housing properties in Ohio and West Virginia.

Reached at his office in Columbus, Kontogiannis said he could not comment on pending litigation.

The case has been assigned to Circuit Court Judge James P. Mazzone.
